I think the best course of action is to keep pressure on for Trump to resign, pointing out the continual efforts for more insurrection aka his tried Twitter posts last night and do by all means get the impeachment through the house. But once the senate puts it off to after Jan 20th, hand it off to Justice and FBI. There is more than enough criminal evidence to proceed with criminal charges once he is the ex president.

Since 5 people now died in the process of committing a crime (storming the capitol), can't prosecuters just charge everyone with those 5 deaths?
Or do they only do that with black people?

Three people died because they couldn't handle the excitement and got heart attacks lol x) Nothing to prosecute there.

I doubt the officer who shot the woman dead is going to face charges.

But if they catch the person who struck the dead police officer in the head and other people involved in that particular scuffle, they will obviously be charged.

Heard Trump is planning to go to Mar a Largo or Scotland on Jan 20th to avoid inauguration. Problem is residents in Mar a Largo have a movement to reject the Trumps due to property violations and the Scottish PM has said the country is in lockdown due to covid and a trip to play golf is not an essential service!

Hope this is a sign of things to come. Only place he will be wanted is a prison cell!

No what I mean, and I am serious: if in America, someone is harmed during the committing of a crime, everyone involved in committing the crime can be charged for it, and a policeman did die. I don't know enough about US law to actually know if that applies here, but I'd love it if somebody knew and explained it to me when it does apply, and why it doesn't here.

If you're referring to the leaders of the mob, they'll get charged for the crimes they personally committed. As for the people who incited them (Trump, Cruz, Hawley, etc) the challenge is finding a tangible link from them to the organizers of the riot, something real that has them coordinating the whole thing. I seriously doubt they'll find such a smoking gun. The people around these politicians will see to that. They may be demagogues, but they aren't stupid enough to incriminate themselves this way. And the speeches at the rallies are not enough. Far too circumstantial.

Unfortunately for the leaders of the mob, the ones yanking their chains are going to get away with this.

you rob a bank, you escape, and in your escape car, accidentally run over a pedestrian, who dies.
You can now be charged with murder in the US.

If you storm the capitol (also a crime), and a policeman dies (also kind of an accident), can you also be charged? If not, why not?

@Viva I know what you mean. It happens often in trespassing situations.

Like say 3 people trespass, try to break into a house to steal something. Something happens and it ends up with a person being dead. They can all be charged with murder regardless of the particular circumstances regarding the death since their crime created that situation.

First things the democrats need to do is to prevent a civil war. I know the possiblity seems remote but the rightwings needs some cooling down and weakening before they could be properly prosecuted.

The best thing to do to prevent civil war is to act harshly on the fascists so that there are no doubts that a 2nd attempt will have real consequences. If you act softly they will only be emboldened.
